Those who freely access the Website will be considered Users for the purposes of this Legal Notice.

3. Applicable legislation

This Legal Notice, which also includes the Website's rules of use, shall be construed in accordance with Spanish law. Due to the supranational nature of electronic communications infrastructures, those accessing the Website from other countries must also observe the applicable laws enacted by each state, to the extent that they are mandatory.

3. Rules of use

3.1 Purpose and acceptance

The main purpose of these rules is to regulate access to the Website. All Users are obligated to comply with them. Access to and browsing of the Website implies express and unreserved acceptance of the provisions included in this Legal Notice. Therefore, if any User does not agree with any of them, they should not access or browse the Website.

3.2 Suspension of the Website

The operation of the Website relies on servers from service providers connected through public and private communications infrastructures.

Access to the Website may be suspended for technical reasons or due to force majeure, such as:

Power or telephone supply failures.

User errors when accessing the Website.

Fires, floods, earthquakes or other acts of nature.

Strikes or labor disputes.

War conflicts or other situations of force majeure.

The above causes, which are stated for illustrative purposes but are not limited to, are either unforeseeable or foreseeable, and are unavoidable.

TERMS AND CONDITIONS OF PURCHASE

1. OBJECT

The purpose of these terms and conditions of purchase (hereinafter, the "Terms and Conditions") is to regulate the purchase of products through the website www.latiendadelasgorras.com (hereinafter, the "Website").

These Terms and Conditions shall apply without prejudice to the rules of use of the Website established in the Legal Notice, which applies to all visitors to the Website by simply accessing it and which can be consulted in the LEGAL INFORMATION area.

The Website is owned by LA TIENDA DE LAS GORRAS SL, whose identifying details can be found here in the LEGAL INFORMATION area.

The Caps Store SL is not obligated to compensate the user or third parties for the consequences of using the product, whether direct or indirect damage, accidents suffered by people, damage to property other than the product, loss of profit or earnings, or damage resulting from deterioration.

The Caps Store SL is not responsible for any typographical or content errors in product specifications that may occasionally occur, and, like prices, these specifications are subject to change without notice.

2. TERRITORIAL SCOPE AND SHIPPING COSTS

LA TIENDA DE LAS GORRAS will ship to any country. Shipping is free within the Spanish peninsula for purchases of €50 or more. Shipping to other countries, Ceuta, Melilla, and the Canary Islands will incur an additional cost.

For international shipments (outside Spain) and to Ceuta, Melilla, and the Canary Islands, the receiving state may require payment of taxes and/or customs fees that are not included in the order price. Customers should inform themselves of these conditions.
The incoterm applied to our international shipments is CPT.
If the corresponding customs fee is not paid, at the customer's discretion, the package will be considered abandoned and not returned, and the order amount will not be refunded.

The customer may cancel the order in whole or in part as long as the merchandise has not been shipped.

3. DELIVERY OF THE PRODUCT(S) SUBJECT OF THE ORDER

LA TIENDA DE LAS GORRAS is committed to delivering orders within 5 business days if shipped within the Iberian Peninsula and between 15 and 30 days to other territories.

4. RETURNS

Before you begin, please note that we cannot guarantee the availability of any product, so returns are only accepted.

Return costs will always be borne by the customer, unless there is a defect or fault. These costs will be indicated throughout the return process through the platform.

Please pay attention to the following requirements:

  • Exchanges and returns are not accepted after 14 days of delivery. You have two weeks to begin the process through our Returns Portal.
  • Items must be in perfect condition and free of any signs of use.

To access you must enter the order number and email or mobile number .

Once you're in the Returns Portal, select the products you want to return and follow the instructions.

Once we've received the package and verified that everything is in order, we'll issue the refund. It may take up to a week to complete.

For pre-ordered products, exchanges and returns will not be accepted unless there are defects or flaws. Since this product is made to order, it will be considered personalized.

5. RIGHT OF WITHDRAWAL FOR CONSUMERS AND USERS

 You have the right to withdraw from this contract within 14 calendar days without giving any reason. The withdrawal period will expire 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the last of these goods. To exercise your right of withdrawal, you must notify La Tienda de las Gorras SL, with address at Calle Jorge Juan 54, 4 izq, telephone number 914451931 or email info@latiendadelasgorras.com, of your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax, or email). You may use the model withdrawal form below, although its use is not mandatory.

To comply with the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of this right before the corresponding deadline expires.

Consequences of withdrawal:

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method we offer), without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will process the refund using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a result of the refund. We may withhold the refund until we have received the goods back or until you have supplied proof of having sent them back, whichever is earlier.

You must return or deliver the goods directly to us or to La Tienda de las Gorras SL, with address at Calle Corredera Alta de San Pablo 30 and telephone number 914451931 , without undue delay and, in any event, no later than 14 calendar days from the date on which you notify us of your decision to withdraw from the contract. The deadline will be deemed to have been met if you return the goods before the deadline has expired. [You must bear the direct cost of returning the goods.]

You will only be liable for any diminished value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.

6. WARRANTY and LITIGATION

If you purchase a product as a consumer and user, you have the right to corrective measures, free of charge, in the event of non-conformity in the goods. We offer guarantees on the products we sell through this website, in accordance with the legally established terms for each type of product. We are therefore responsible for any non-conformity that becomes apparent within three years of delivery.

It is understood that the products comply with the contract provided that (i) they fit the description made by us and possess the qualities that we have presented on this website, (ii) they are suitable for the uses to which products of the same type are ordinarily intended and (iii) they present the quality and performance usual for a product of the same type that can reasonably be expected. In this sense, if any of the products do not comply with the contract, you must inform us by following the procedure detailed in section 17.6 above and through any of the means of communication provided for this purpose.

The products we sell, especially handcrafted products, may often exhibit characteristics of the natural materials used in their manufacture. These characteristics, such as variations in grain, texture, knots, and color, are not considered defects or flaws. On the contrary, they should be expected and appreciated. We only select products of the highest quality, but natural characteristics are inevitable and should be accepted as part of the product's individual appearance.

Our commercial guarantee will not affect the rights you have under current legislation.
